The installation of some solar panels can be classified as Exempt Development, which does not require development consent. To be exempt development, the solar panels must meet the development standards outlined in Section 2.41 (4) of the State Environmental Planning Policy (Transport and Infrastructure) 2021 and the General requirements for exempt development.
If the development standards or general requirements outlined in the Policy cannot be met, then development consent must be sought prior to installation.
Development consent for the installation of solar panels can be sought through a Complying Development Certificate (CDC). To be complying development, the solar panels must meet the development standards outlined in Section 2.39 (2) of the State Environmental Planning Policy (Transport and Infrastructure) 2021 and the General requirements for complying development.
If the development standards or general requirements outlined in the Policy cannot be met, the development does not qualify as Complying Development and a Development Application must be lodged.
Development consent for the installation of solar panels can be sought via a Development Application (DA), provided the proposal meets the relevant planning controls.
Development Applications for solar panels are assessed against the provisions of the Newcastle Local Environmental Plan 2012 (LEP) and the Newcastle Development Control Plan 2023 (DCP).
